Probate of Estates In Pennsylvania
Not all Estates must be probated. However, when a person dies leaving assets that must be transferred to the heirs by way of a signed document (a deed, a title, etc.), it is necessary to open a Probate and have the Court appoint a Personal Representative or Executor to “stand in the shoes” of the deceased relative and sign the pertinent transfer documents.
Pennsylvania also requires the heirs of an Estate to file an Inheritance Tax return within nine (9) months of the decedent’s death, after which interest, and perhaps penalties, are applied.
